Subterranean Termite Treatment and Warranty Terms and Conditions

1.  State Regulations

When an estimate or proposal for termite treatment is submitted to a consumer the pest control company must provide the following written disclosure information: For all treatments there will be a diagram showing exactly what will be treated. Treatment specifications and warranties for those treatments may vary widely. Review the pesticide label provided to you for minimum treatment specification. If you have any questions, contact the pest control company or the Texas Department of Agriculture, P.O. Box 12847, Austin, Texas 78711-2847. Telephone number (866) 918-4481 or Fax: 888-232-2567. Documentation shall also include but is not limited to approximate perimeter measurement of the structure, areas of active or previous termite activity, the concentration of any liquid termiticide application to be used or the minimum number of baiting systems installed or the square footage if a barrier is installed. The consumer is advised to review all this information and the pesticide label for explanations of the proposed treatment and compare this with any other proposal or estimate they may receive.

2.  State Definitions of Treatment.

a.   Partial Treatment: This technique allows a wide variety of treatment strategies but is more involved than a spot treatment. (See definition below.) Ex: treatment of some or all of the perimeter, bath traps, expansion joints, stress cracks, portions of framing, walls and bait locations.

Pier and Beam: Generally defined as the treatment of the outer perimeter including porches, patios and treatment of the attached garage. In the crawl space, treatment would include any soil to structure contacts as well as removal of any wood debris on the ground.

Slab Construction: Generally defined as treatment of the perimeter and all known slab penetrations as well as any known expansion joints or stress cracks.

b.   Spot Treatment: Any treatment which concerns a limited, defined area less than ten (10) linear or square feet that is intended to protect a specific location or "spot." Often there are adjacent areas susceptible to termite infestation, which are not treated.

c.  Baiting System:  This type of treatment may include interior and/or perimeter placement of monitoring or baiting systems along with routine inspection intervals. The baiting technique may include one or more baiting locations as prescribed by the product label and instructions.

d. Barriers:  If a physical device is used, the square footage of the physical device must be recorded and a diagram describing the installation will be provided

3. Warranty

a. Area Included in Warranty:  The warranty includes spot treatment of any subterranean termite (Formosan Termites Excluded) infestation or re-infestation of the structure that may be discovered while the agreement is in force.  

b.  Length of Warranty and Renewal Option:  This Warranty shall be effective for an original period of one year, after 1 year, the warranty may be extended annually upon Customer payment to Venus Pest Company “VPC” of the agreed upon annual or monthly Renewal Fee.  An annual termite inspection is included with the cost of the renewal fee.  Renewal Fee Price adjustments may be negotiated after the 3rd year.

c.   Customer Right to Cancel:  If VPC fails to comply with the specifications, they shall be given thirty (30) days notice to render satisfactory service.  If, at the expiration of such thirty (30) days notice, the unsatisfactory conditions have not been corrected, the Customer reserves the right to cancel the agreement.

d.  Transfer of Warranty:  This warranty is 100% transferrable to subsequent owners of the property.

4. Warranty Limitations.

a.  Customer Obligations:  The responsibility of VPC under this Agreement will be terminated under the following conditions: presence of termite conducive conditions including but not limited to failure to repair water leaks, improper drainage or ventilation; failure to prevent flooding or maintain a proper grade around the foundation; Disturbance of treated soil around the foundation; additions to the structure without proper termite treatment; or VPC is unable to render service due to lack of availability of said premises by the owner or duly authorized agent.

b.  Force Majeure:  The responsibility of VPC under this Agreement will be terminated if VPC is prevented from fulfilling its responsibilities under the terms of this Agreement by reason of delays in transportation, shortages of fuel and/or materials, strikes, embargoes, fires, floods, quarantine restrictions, earthquakes, hurricanes or any other act of God or circumstances or cause beyond the control of VPC.  VPC reserves the right to adjust the service charge in the event of any such occurrences or happenings.

c.   Other Pests/Organisms:  This Agreement provides for treatment and re-treatment for pests indicated herein.  This Agreement does not provide for treatment of Formosan subterranean termites, drywood termites, beetles, fungi or any other wood destroying organism not specifically stated in this agreement.

d.  Damage:  This agreement does not warranty against property damage or personal injury caused by termites, other arthropods, wildlife, or other wood destroying organisms.
